Today TTB published their exceptional guidance for this event. The announcement relaxes a few of the reporting requirements, and also opens the door for wholesalers and retailers that lost tax paid goods to claim credits for the taxes on tax paid goods lost.
Holtzclaw Compliance is willing to offer up to one hour pro bono consulting and assistance to Industry Members that were directly affected by the fires. Call us at 209-883-7031 or e-mail info@holtzclawcomp.com.
To briefly summarize what is required:
- Gather documentation as to losses.
- Collect proof in some form that you were directly affected.
- If you didn’t burn but were forced to evacuate and couldn’t file a report or return timely, proof that you couldn’t access your office and/or records to file or pay.
- When losses are determined, report bonded wine lost on your 5120.17 and file a claim for casualty loss.
- Report tax paid wine lost and file claims to get back taxes paid.
- If the winery is damaged and you cannot operate there for a period of time, notify TTB and advise that you will not report until operations resume.
